1. Agreement to Terms
By booking a tour with Banff Journey ("we", "our", or "us") or using our website banffjourney.org, you agree to be bound by these Terms & Conditions. Please read them carefully before making a booking. Banff Journey is operated from Calgary, Alberta, Canada.
2. Booking & Payment
A booking is confirmed once full payment has been received and a confirmation email or message has been sent to you. Prices are listed in Canadian dollars (CAD). We reserve the right to correct pricing errors; in such cases we will notify you before processing payment.
Most tours require a minimum of 4 participants to operate. We strongly recommend contacting us the day before your tour to confirm departure. If a tour does not meet the minimum participant requirement, we will offer you a full refund or the option to transfer to another available date.
3. Cancellations & Refunds
- More than 24 hours before departure: Full refund — no questions asked. You may cancel via WhatsApp or email.
- Within 24 hours of departure: Bookings are non-refundable, though we will do our best to reschedule depending on availability.
- No-show: No refund.
If Banff Journey cancels a tour due to weather, road closures, safety concerns, force majeure, hostilities, strikes, quarantine, or any other circumstances beyond our reasonable control, you will receive a full refund or the option to rebook at no additional charge. Upon notifying passengers of such a cancellation, Banff Journey shall be released from all further liabilities and obligations related to that tour.
4. Itinerary & Schedule Changes
Itineraries are provided as a guide only. Banff Journey reserves the right, at its sole and absolute discretion, to cancel, shorten, or modify the schedule or itinerary of any tour in the following situations:
- Force majeure, hostilities, accidents, or other circumstances beyond our control
- Weather or road conditions that, in Banff Journey's reasonable opinion, make the original itinerary unsafe or impractical
- Wildlife activity, Parks Canada directives, or access restrictions at specific locations
Our guides will make every effort to substitute destinations of equal or greater interest and to provide the best possible experience given prevailing conditions.
5. Liability & Assumption of Risk
Participation in guided outdoor tours involves inherent risks including, but not limited to, uneven terrain, wildlife encounters, adverse weather, and physical exertion. By booking a tour you acknowledge these risks.
Banff Journey assumes no responsibility for any injuries, damages, losses, accidents, delays, inconveniences, or irregularities suffered by passengers as a result of sickness, weather conditions, strikes, war, quarantine, changes in advertised schedules, or the actions or failures of any third-party service provider.
Our liability is limited to the price of the tour booked, except where loss or injury is caused by our gross negligence. We carry appropriate public liability insurance.
6. Personal Belongings
Personal belongings are carried entirely at the passenger's own risk at all times during the tour. Banff Journey accepts no responsibility for lost, stolen, or damaged personal items.
7. Guest Eligibility & Conduct
- Children: Guests under the age of 16 must be accompanied by a parent or legal guardian at all times. Please mention any car seat or booster seat requirements when booking.
- Identification: Photo identification may be required to verify your identity on the day of the tour.
- Health & fitness: Guests are responsible for ensuring they are physically and medically fit to participate. Please inform us of any health conditions or mobility limitations at the time of booking.
- Conduct: Banff Journey reserves the right to remove any guest whose behaviour is disruptive, dangerous, or harmful to others, without refund.
8. Photography & Media Consent
By participating in a tour with Banff Journey, guests acknowledge and accept that we may record videos and take photographs during the tour. These materials may be used in promotional content across our website and social media platforms. If you do not wish to appear in promotional materials, please notify your guide at the start of the tour.
9. Health & Safety
Guests must follow all safety instructions given by their guide. Banff Journey reserves the right to refuse or remove any guest who poses a risk to the health and safety of themselves or others. A liability waiver may be required to be signed on the day of the tour for certain activities.
10. Governing Law
These Terms & Conditions are governed by the laws of the Province of Alberta and the applicable federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta.
